Gagiev, to join in the implementation of the plan aimed at the murder of H. Bibilov, carried out by S. Beglaryan.
Beglaryan S.L. and Gagiev O.S. gave their consent to participate in the upcoming crime and decided to involve members of the gangs led by them, namely Yurtova R.V., Dudiya I.A., Yashkina E.I., Nikolaeva M.K., members of the stable armed group Beglaryana S.L., Bagaeva R.A. and Kodoeva D.O., who were members of the gang of Gagiev O.S.
Also, Gagiev A.M., involved in the murder of Bibilov H.A. member of the criminal organization Dzhioeva AB and at least two unidentified members of the criminal community.
According to the plan of A. Gagiev, it was supposed to find out from a friend Bibilov H.A. - Alborova L.T., about the whereabouts of the latter, after which they fraudulently lure them to a convenient place, where to capture and then commit the murder of both of them.
In the period from December 2007 to September 27, 2008, the exact date has not been established, A. Gagiev, O. Gagiev and Beglaryan S.L., developed a detailed plan for the commission of the specified murder and distributed the roles among the accomplices. They left behind themselves control over the execution of the criminal plan. Dzhioev A.B. and Bagaev R.A. should have fraudulently lured Alborov L.T. and Bibilova H.A. to the office of OJSC Financial Leasing Company, after which Beglaryan SL, Dudiy I.A., Dzhioev A.B., Kodoev D.O., Yashkin E.I., Bagaev R.A., Nikolaev M .K., Yurtov R.V. and at least two unidentified participants in the criminal organization must implement and their seizure, subsequent forced confinement, in order to prevent their flight. Acting in accordance with the developed criminal plan to commit the murder of L.T. On the arrival of Dzhioev A.B. and Alborova L.T. to the indicated cafe, Dzhioev A.B., under an imaginary pretext, offered L.T. Alborov and Bibilov H.A. drive with him to the office of OJSC Financial Leasing Company, to which the latter agreed.
On the night of September 27-28, 2008, at approximately 00:00, arriving at the indicated office, Dzhioev A.B., Alborov L.T. and Bibilov H.A., went into the room and went into one of the offices, where they had a conversation with Gagiev A.M. After a short time, as directed by A. Gagiev. on the capture of the latter, Beglaryan S.L., Nikolaev M.K., Dudiy I.A., Yashkin E.I. and at least two unidentified members of the criminal community, jointly and in coordination with Bagaev R.A. and Dzhioev AB, being in the office of OJSC “Financial Leasing Company”, located at the address: Moscow, st. Makarenko, d. 6, building 1, dressed in uniform of police officers and, posing as such, attacked L. Alborova and Bibilova Kh.A., used physical force to them and forcibly holding them, escorted to the basement, where with Bibilov Kh.A. talked Gagiev O.S.
While finding Alborova L.T. and Bibilova H.A. in the indicated basement of the office of OJSC Financial Leasing Company, Dudy I.A., fulfilling the role assigned to him in the crime, jointly and in coordination with Dzhioev A.B., Kodoev D.O., Yashkin E.I., Nikolaev M. .K., Bagaev R.A. and at least two unidentified participants in the criminal organization, guarded the captured persons in order to prevent their flight, for the subsequent commission of their murder.

At the same time, Nikolaev M.K. and Beglaryan S.L., being in the indicated sauna room, put on the head of Bibilov H.A. a pre-prepared polymer bag, wrapped it around the neck of the last with adhesive tape - scotch tape, blocking air access to the respiratory organs, as a result of which Bibilov H.A. died at the scene from mechanical asphyxia, which entailed serious harm to health on the grounds of danger to life.
On the same night, September 28, 2008, after the murder of Alborov L.T. and Bibilova H.A., in order to hide the traces of the crime, Beglaryan S.L. and Nikolaev M.K., using axes, dismembered their corpses. Bagaev R.A., Kodoev D.O. and unidentified members of the criminal community packaged parts of corpses in plastic bags. In packages in which there were heads and brushes of corpses, Nikolaev M.K. He reported metal nuts and bolts for weighting and subsequent drowning. Yurtov R.V. loaded plastic bags with parts of the bodies of Alborov L.T. and Bibilova H.A., except for heads and brushes, in an unidentified Nissan Almera Classic car, after which R.
