The Rotenberg clan had a project for the Vitawin sports nutrition store of the Doctor Sport company. After Roman Rotenberg rewrote the Doctor Sport company bankrupt by him with a bunch of debts to his girlfriend Yana Ivantsova, the story did not end. On July 22, 2020, the Doctor Sport creditors' meeting approved an amicable agreement, according to which the debtor was "forgiven" 70% of the principal debt and all penalties in full, and the balance was extended for 3 years. By the majority of votes (71% of all claims included in the register), 4 creditors, affiliated with the debtor and his beneficiaries (Rotenberg), voted for this peace. Yana Ivantsova, the "owner" of Doctor Sport, was represented at the meetings by the bankruptcy trustee Maxim Vilkhovsky. One of the affiliated creditors (LLC "CheckEndShip"), at the start of bankruptcy, to control the bankruptcy procedure, Vilkhovsky was proposed as a manager in the supervision procedure. But an independent lender - Kraftberg - was then the first to allow the observation procedure to be carried out not according to the script of the Roman Rotenberg team. But later, thanks to the majority of votes, "Doctor Sport" still managed to put its bankruptcy administrator in the procedure.
According to a Rucriminal.info source, in support of the conclusion of an amicable agreement, Vilkhovsky provided a presentation, which he called a business development plan. It can also be compared with a synopsis of the capture of the sports nutrition market by the "lame duck" of Roman Rotenberg. Despite the complete non-compliance with the requirements for such documents, the Moscow Arbitration Court approved the document that was onerous for real creditors and terminated the bankruptcy procedure. When pushing through the settlement agreement, there were other significant shortcomings. So, even not all representatives of loyal creditors had the authority to vote on the issue of concluding an amicable agreement, and not enough receivables collected by the pocket bankruptcy trustee could be almost enough for everyone.
Six creditors did not agree with the decision of the Moscow Arbitration Court - suppliers and even a charitable foundation, to which Roman Rotenberg's company owes 1 million rubles. Complaints were lodged with the Court of Cassation. But even in him, "justice" was on the side of the Rotenbergs. Arbitration Court Moskow district in the judicial act simply indicated that "the references of the applicants of the cassation complaints to the economic groundlessness of the conclusion and approval of the settlement agreement are far-fetched and premature." Thus, the presentation of "Doctor of Sport" made a significant impression on the judges of the cassation instance.
The cassation took into account the rehabilitation nature of such a procedure as an amicable agreement and, relying on the presentation, provided the debtor "with an opportunity to restore solvency and continue to conduct business." Such a gift to Doctor Sport was made on November 16. The court was not even embarrassed that a month before that, Yana Ivantsova, who had proposed the "development project" of "Doctor of Sport", using the window after the decision of the court of first instance, had managed to relieve herself of the powers of the head. Instead, another character unknown to the market stood up, but this time, more distant from Roman Rotenberg. Well, after 3 weeks, the accounts of Doctor of Sports continue to be blocked by the tax authorities.
While a complaint is being prepared to the Supreme Court, one of the creditors decided to file a claim against SMP Bank itself and the creditors who helped Doctor Sport to throw the rest (case No. А40-216410 / 2020). The amount of the claim is the amount "forgiven" to Doctor Sport, that is, 70% of the debt + all interest and penalties. SMP Bank was the sole owner of the debtor a month before the bankruptcy and has “good chances” of being brought to subsidiary liability.
