Gennady Kutuzov, head of the Krasnodar laboratory of forensic examination of the Ministry of Justice of the Russian Federation, became a defendant in a criminal case on abuse of authority and forcing an expert to give a deliberately false opinion.
The first about his detention of Kutuzov was an employee of the TFR and the FSB Directorate for the Krasnodar Territory, who reported the telegram channel of the Cheka-OGPU. Kutuzov is suspected of forcing a subordinate expert to give a deliberately false conclusion, forcing an expert to evade testimony and exceeding official powers, which manifested itself in forcing employees of an expert institution to pay tribute. As sources told Rucriminal.info, Kutuzov also built a whole system of extortions from operatives and investigators, he especially loved the employees of the local BEP - one hint and they immediately carry a "pretty penny" to bring the cherished expertise closer. Otherwise, the results could be submitted for a very long time, and the results could be such that the operatives would not like it. In 2015, by decision of the Leninsky District Court of Krasnodar, Kutuzov was disqualified for 3 years from his post for the offenses. However, thanks to his patrons in Moscow, the disqualification was replaced by a higher court with a fine of 2,000 rubles and Kutuzov continued to engage in his illegal activities. He also had violations during the declaration campaign, which was known to the Ministry of Justice and the prosecutor's office, but nothing, he continued to work. His favorite saying: "Loot wins everything!"
His main Moscow patron Kutuzov did not particularly hide - this is the director of the Russian Federal Center for Forensic Science under the Ministry of Justice of the Russian Federation, Svetlana Smirnova.
The adage "Loot wins everything!" The other “hero” of the Kuban, the influential fixer Andrey Matyushenko, also liked him very much. First of all, he decided with representatives of law enforcement agencies and the judiciary. According to a Rucriminal.info source, in particular, Matyushenko was friends with the judge of the Oktyabrsky Court of Krasnodar Starikova M.A., with the judge of the Krasnodar Regional Court Galina Malakhai, etc. He was assisted by lawyer Alexander Pozhidaev, who is also a friend of Marina Starikova, judge of the October City Court of Krasnodar.
But in 2015, Andrei Matyushenko ended up in jail. Then he committed the theft of 8,650,000 rubles by deception, convincing two men that he had the opportunity to solve their legal problems in the Supreme Court of the Russian Federation with the involvement of the chairman of the Council of Judges of the Russian Federation - V.V. Momotov, and disposed of the money at his own discretion.
He, in November 2016, offered and promised mediation in the transfer of a bribe to the judge of the Prikubansky District Court of Krasnodar - G.N. Ermolov. in the amount of 1,100,000 rubles for refusing to satisfy the request of the head of the colony to change the type of correctional institution to the convicted person, who was recognized as a malicious violator, but was caught red-handed by the FSB officers in the Krasnodar Territory.
By a verdict of the Pervomaisky District Court of Krasnodar on May 15, 2018, Matyushenko was found guilty of committing corruption offenses under Part 4 of Art. 159, part 5 of Art. 291.1 of the Criminal Code of the Russian Federation and he was sentenced to 5 years in prison with serving in a general regime colony.
As it became known to Rucriminal.info, on October 27, 2020, by the decision of the Primorsko-Akhtarsky District Court of the Krasnodar Territory, convicted Andrey Matyushenko was released on parole.
The victim, Yuri Anishchenko, did not agree with such a decision, by the way, who accidentally learned about the happy release, because they forgot to ask his opinion and invite him to court.
And Yuri's arguments deserve attention and make you think. Personally, the chairman of the Primorsko-Akhtarsky District Court of the Krasnodar Territory - Belozerov R.G., deciding on the release of Matyushenko, took into account that the convict had paid insurance premiums in the amount of 30,984.86 rubles. in favor of the Pension Fund Office! That is, in the opinion of the court, the fact that the convict worried about his future pension clearly indicates his correction. But the judge did not consider the fact that not a single ruble was paid to the victim as compensation for harm caused by the crime.
The convict did not differ in exemplary behavior. From the moment of his arrival in the colony until the moment of his release by the court, Matyushenko had no penalties for less than two months. From the documents that the colony submitted against the convict, it is clear that the entire term of serving the sentence of Matyushenko was systematically violated the internal regulations, for which he received penalties up to placement in the punishment cell. And six months before the petition for parole, the behavior of the convict suddenly changed, he received two rewards, and the third - practically in the courtroom, during the period of consideration of the issue of release.
Indeed, a very fortunate coincidence. And very doubtful.
But the judge dismissed his doubts and ordered Matyushenko to be released so that he could return to his family, find a job, a law abiding lifestyle. Only Matyushenko has nowhere to return, there is only false information about the registration of the convict at the place of residence, provided by the colony.
It is interesting that the judge assigned control over the return of Matyushenko to normal life on the head of the Ministry of Internal Affairs for Krasnodar - Ostapeno D.P. However, according to Art. 187 of the RF PEC, such control is carried out by the criminal executive inspection at the place of residence (which Matyushenko does not have). This means that control over Matyushenko will not be carried out at all simply because the head of the Ministry of Internal Affairs for Krasnodar is not endowed with such powers.

Analyzing the situation, it is difficult not to accept the indignation of the victim when a person convicted of a crime of corruption gains freedom, easily breaking down, albeit imperfect, but stable judicial practice prevailing throughout the country.
What is it? The strongest blow to the fight against corruption, or a manifestation of this very corruption.
In fact, any court decision should not be liked or disliked. It is either legal or illegal.
This issue will be decided by the Krasnodar Regional Court.
